Consumercate, Inc. ("Consumercate") operates an ecommerce website (“Site”) and provides other services ("Services") designed to enhance the reputation and consumer communication of its clients, Internet Retailers. We understand the importance of and are committed to protecting the privacy and security of the information we may gather about our visitors. We appreciate your trust that we will use and share that information carefully and sensibly.
Consumercate is a company incorporated in the United States of America. Accordingly, information submitted by you to Consumercate will be transmitted to, held and processed in the U.S.A. The Consumercate privacy policy ("Privacy Policy") describes our practices concerning your privacy. By visiting the Consumercate Site you accept our User Agreement. By using Consumercate services, or otherwise interacting with Consumercate, you are consenting to the Consumercate practices, including the use and disclosure of any personally identifiable information you have shared with us, as described in this Privacy Policy. Consumercate is 100% opposed to unsolicited commercial e-mail ("spam"). We do not send e-mails to anyone without permission and we do not sell or provide e-mail addresses to any unauthorized third party. If you receive any e-mail spam, please be assured that Consumercate did not provide your e-mail address to such parties.

The information we collect is used solely for the purpose to offer you a more personalized and efficient customer experience and to continually provide products and services that will fulfill your needs as a client. Listed below are the general types of information we gather.
We receive and store any information you provide to us when you: become a Consumercate member; submit a review or survey; communicate by e-mail; telephone or mail our customer service; or otherwise interact with us. Such information may include your name, address, e-mail address, shopping interests and preferences, birthday, hometown, transaction history, and other personal data. You can choose not to provide certain information, but then you might not be able to take advantage of certain useful Consumercate features.
We automatically receive, store and track certain types of information whenever you interact with the Consumercate Site or Services, regardless of whether you are a registered user. We use this information to conduct internal research on the Web Site visitors' demographics, interests and behaviors in order to better understand, protect and serve you and the Consumercate community.
A cookie is a small text file stored on a user's computer in order to identify that user to the website on their next visit. Cookies enable our systems to recognize your browser and to provide convenience and other features to you, such as recognize you as a Consumercate member. Additionally, as with similar information gathered in the log files, the information we collect in the cookie may include a unique identifier that tracks your activity on the Consumercate Site.
We may use session cookies. A session cookie expires and is deleted from your computer when you close your browser. We use session cookies to make it easier for you to navigate our Site and to receive the greatest benefit from our Site and Services.

Consumercate members are required to register in order to use our Services. Each Consumercate member must provide their business name, business address, phone number, administrator's name, administrator's e-mail address, as well as a password for the administrator.
All Consumercate members are required to provide correct and truthful contact information (such as a valid e-mail address) in accordance with our Terms of Service. In addition to basic Site and Services registration data, any individual information, such as a name, address, and/or other personally identifiable information that you voluntarily provide to Consumercate is considered to be personal information under this Privacy Policy. Business information including, but not limited to a business name, business address, business phone or fax number, business web site, and other business related contact information are not considered personal information and may be used by Consumercate at our discretion.
We may collect and use such information that you or other users or third parties send us through personal communication, such as e-mails or letters about your activities or postings on the Site or Services. Any business ideas or inventions that are communicated through our Site or Services may also be collected and retained. Any feedback, business information, ideas, concepts, or inventions that you send or submit to Consumercate by e-mail or through the Site or Services are not protected in this Privacy Policy. Please do not send us any business information, ideas, concepts, and/or inventions, private or proprietary, if you wish to keep them private and do not want Consumercate to use them. Consumercate may use any feedback, information, ideas, concepts and/or inventions that you provide to Consumercate for any purpose without limitation and without any obligation to compensate you monetarily or otherwise.
Any personal information, including content, that you post on public forums, blogs, bulletin boards, chat rooms, or other public areas and/or that you consent to share or make public ("Public Zones") through the Consumercate Site or Services is not protected by this Privacy Policy and as such we do not control the use and/or disclosure of this information. Personal information that you post to a Public Zone or communicate through a Public Zone can and may be used by third parties to contact you or to convey this information to others, including in Public Zones of other websites. We recommend that you do not post any private or confidential information in a Public Zone.
Advertisers, sponsors or other third parties with whom we work may also use their own cookies when you click on their advertisement or link to their site or service. These cookies are used to collect non- identifiable information when you visit our Web Site and other sites. This information may be used to enhance Consumercate products and features, or to conduct market research and website analysis. Some advertisers use companies other than Consumercate to serve their ads and these companies may also collect non-identifiable information through the use of cookies on our Site and/or Services. We do not control these third parties' use of cookies, or how they manage the non-identifiable information they gather through.
Children
We are committed to protect the privacy of children. The services provided by Consumercate target a general audience and are not designed or intended to attract children thirteen (13) years of age and under. We do not collect personal information from any person whom we actually know is under the age of 13. Consumercate will not be held liable for any falsification of personal information by a Site user which results in the collection of personal information from a person thirteen years of age or under.
INFORMATION THAT CONSUMERCATE SHARES
Information about Consumercate members and other users is an important part of our business. We take the necessary steps to maintain the privacy and security of such information against unauthorized access. Unless otherwise described in this Privacy Policy or as specifically agreed to by you, Consumercate will not disclose to third parties any personal information that you submit to our Site or Services. In an effort to serve you better and improve your online shopping experiences, we may also share such information in a responsible manner as described below.
Agents
At times, we employ other companies and agents (third parties) to perform various functions on our behalf, such as sending postal mail and e-mail and providing other data and services. In such instances, these third parties may have access to personal information needed to perform their functions, but are prohibited from using this personal information for other purposes.
Any non-personal information that is provided to Consumercate by its users may be shared with third parties. This non-personal information that may be shared by Consumercate with its third parties does not give the third party the ability to identify or contact you. The use of this information by third parties cannot fully be controlled by Consumercate, however, we do require that the third parties to whom we disclose this information agree that they will not attempt to make this information personally identifiable by combining it with other databases and/or other sources of information.
Business Transactions and Legal Disclosures
As our business continues to develop we may share information with affiliates and participate in corporate transactions such as mergers and acquisitions, or insolvency proceedings involving other entities. It is possible that another company may acquire Consumercate or its business assets in the future. In the event of such occurrences, user information may be shared with the acquirer and/or other reputable parties involved in those transactions. Users will be notified via e-mail or prominent notice on our Web Site for 30 days prior to a change of ownership or control of their personal information in such a transaction. We provide you with 30 days notice to allow you the opportunity to notify Consumercate if you do not wish for such information to be shared during such business transactions, by notifying us through privacy@consumercate.com.
Consumercate may also disclose your personal information as required by law or when it is appropriate to enforce or apply our Terms of Service or other agreements; in connection with insolvency proceeding involving all or part of the business or asset to which the Personal Information will pertain; or to protect the rights, property, or safety of Consumercate, our Business Members, Users, or others. The latter includes information exchanging with third party companies and organizations for the purpose of fraud protection and credit risk reduction. In the event that we are legally obligated to disclose your personal information to a third party, we will notify you unless doing so would violate the law or a court order.
Consumercate considers the submission of content by any user to be public, non-confidential information and such information shall not be treated as personal or proprietary information. Such content may be aggregated by the user and made available to all users of Consumercate. Consumercate does not monitor, evaluate or alter the user contributions made to the Site and/or Services. We recommend that users avoid the inclusion of any private or confidential information or any personal information in their content that they do not wish to be made public. In no event will Consumercate be liable for the disclosure of information considered by the user to be personal, private and/or confidential if said user includes this information in the user content.
We may use your information we collect to contact you for administrative purposes and/or provide you with customer service; Site and/or Service maintenance and updates; respond to any questions, problems or complaints, or request feedback; and send you e-mails containing information about products and services that you might find of interest.
Consumercate may send you information on new products, services, features, promotions or other information. If you decide that you do not want to receive these types of communications from Consumercate, you may opt-out of this service by changing your preferences and settings within your account.
We may contact you, based on the information that you provide us, through e-mail, phone or traditional mail in order to provide you with the utmost level of customer service. We will use the information you provide to us to communicate with you regarding the Site and/or Services or to manage your account.
As a Consumercate member your business profile will contain your business and contact information, and not your personal information as previously described. Any user of the Consumercate Site or Services will have the ability to view the information continued in your business profile, but will not have the ability to access your personal information including your name, personal e-mail address and personal password.
If you register as a Consumercate member, Consumercate provides you access to your registration information (for example, name, e-mail address or zip code) in order to view and update this information. If the personal information in your personal or business profile is inaccurate, or if you would like to cancel our service, you may add, update or delete your registration information and/or disable your account. To make any of the aforementioned changes to your profile information, you will need to enter the appropriate changes to the relevant profile page(s) and your account.
In some circumstances, Consumercate will retain your personal information after you have deleted your profile, for purposes such as resolving disputes, troubleshooting problems and enforcing our Terms of Service. Additionally, this type of information is never completely removed from our databases due to technical and legal restrictions.
SECURITY
We work to protect the security of your personal information that is submitted to us during transmission and when we receive it. However, no system is completely infallible and while Consumercate cannot completely guarantee its Site security, we take all available measures to ensure that our security priorities are up to date and are commercially acceptable.
Consumercate may send newsletters and other e-mail and notifications to members and others who have agreed to be contacted by Consumercate. You always have the option to not receive Consumercate e-mails. A link is provided at the end of every e-mail message that provides you the opportunity to change your e-mail subscription preferences or to be completely removed from our mailing list.
Consumercate reserves the right to revise this Privacy Policy at any time and will notify you of any significant changes that will alter the method in which we disclose your personal information. Since our business changes constantly, this Privacy Policy will also change from time to time. Users will be notified via e-mail or a prominent notice on our Web Site for 30 days prior to the effective date of any material changes to this Privacy Policy. We may also make non-substantial changes to our Privacy Policy that generally will not affect our use of your personal information. Please be sure to frequently review our Privacy Policy on the Consumercate Site for any changes that we may undertake. If you do not agree to the terms of this Privacy Policy or any future revision thereof, please discontinue the use of the Consumercate Site and/or Services immediately.
